Q&A: Appointment of the Eldest Assistant as Temporary Ameer

Question: In the Name of Allah the Great and from Him I get the support: Our Honourable Scholar:  As-Salaam Alaikum Wa Rahmatullah Wa Barakaatuhu I have two questions; can you kindly honour me with their answers? I ask Allah to guide your steps and of those working for the resumption of the Islamic way of life: It is stated in the book The Draft Constitution, The Necessary Evidences for It Part One page 218 (English version) Article 33: "b. If the Khalifah dies or resigns before appointing the temporary leader, or the position of the Khilafah becomes vacant due to another reason, then the eldest of the assistants becomes the temporary leader." What is the evidence for this article? Why does the eldest of assistants become the temporary leader and not one who is younger than him? Khilafah Conference Canada 2014 Talk1- The Khilafah, Hizb ut-Tahrir, and Societal Change - Mazin Abdul-Adhim

Recently Ustadh Mazin Abdul-Adhim spoke at the Khilafah conference held in Canada where he  thoroughly defines the work of Hizb ut-Tahrir, and answers three questions that are at the core of this group's efforts:   Does Islam permit such groups to exist in Islam?    What is the method of this group, and why this particular method?    What has this Hizb achieved after all these years? This was followed by a talk (in Part 2) on the deeper details of the work and sacrifice of the Hizb over the past 60 years, and the conference concluded with a detailed and interesting Q&A with the audience on these issues (in Part 3).
