The Hukm (ruling) by what Allah revealed



The following is a translation from an Arabic leaflet.

 
وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ وَاحْذَرْهُمْ أَنْ يَفْتِنُوكَ عَنْ بَعْضِ مَا أَنْزَلَ اللَّهُ إِلَيْكَ

And judge between them by that which Allah has revealed and do not follow their desires and beware that they seduce you from some of what Allah has revealed to you (Al-Maa’idah 49).

Allah sent His Messenger Muhammad with the message of Islaam to the entire world, to guide mankind and to bring into being a global society upon a unique and distinguished form that differs from all other forms and types of human societies existing in the world as a whole. It made its Aqeedah a spiritual and political Aqeedah; assuming the responsibility of that which emanates from it and what is built upon it in terms of thoughts and Ahkaam related to the caretaking of the affairs of the Dunyaa and the Akhirah. It made its viewpoint in life different to all other viewpoints existing in other ideologies and systems, just as it made its thoughts and Ahkaam differ from all other thoughts and Ahkaam existing in the entire world. This is whether it relates to the basis upon which they are established or the source that has legislated them, and whether it is related to its general comprehensive (thoughts and rulings) or its partial (thoughts and rulings).

The Aqeedah of Islaam came with thoughts and Ahkaam related to all of the affairs of life and the human relationships existing within it. They relate to the caretaking of these affairs and relationships whether these are related to ruling, economy, social life, education, foreign policy or domestic policy, and whether they are related to the relationship of the State with other States, nations and peoples, the relationship between the rulers and the ruled, or the relationship of the individuals amongst each other in the transactions (Mu’aamalaat) that take place between them. And they relate to the crimes that happen amongst them which are related to an aggression against the Aqeedah, lives, properties, honour and dignity of the people. In this way the Islamic Aqeedah is a complete and comprehensive political Aqeedah dealing with life in all of its forms and manifestations. It treats all of the realities with precise treatments and solutions.

Allah (swt) said:

وَنَزَّلْنَا عَلَيْكَ الْكِتَابَ تِبْيَانًا لِكُلِّ شَيْءٍ وَهُدًى وَرَحْمَةً وَبُشْرَى لِلْمُسْلِمِينَ

And we have sent down to you the Book (the Qur'an) as an exposition (explanation) of everything, a guidance, Mercy and glad tidings for those who have submitted themselves (Muslims) (An-Nahl 89).

And He (swt) said:

الْيَوْمَ أَكْمَلْتُ لَكُمْ دِينَكُمْ وَأَتْمَمْتُ عَلَيْكُمْ نِعْمَتِي وَرَضِيتُ لَكُمُ الْإِسْلَامَ دِينًا

Today I have completed your Deen for you and have perfected upon you my favour (blessing) and I have chosen for you Islaam as your Deen (Al-Maa’idah 3).

The Ahkaam that emanate from the political Islamic Aqeedah obliges the Muslims to implement Islaam completely and to establish upon its basis a distinguished Islamic entity and to build a unique society which is the Islamic society. Similarly it obliged the Muslims to be one Islamic Ummah irrespective of how much their races, origins and colours differ. This is because they have been brought together by the Islamic Aqeedah which has unified their viewpoint in life upon the Halaal and the Haraam making it the measure and criterion for how they view realities and events in order to issue a judgment upon them under the shade of a single State. This is the Khilafah State which will be under one single flag, the black Raayah of Al-‘Uqaab, the Raayah of Laa Ilaaha Illallah Muhammadur Rasoolullah.

And Allah (swt) commanded His Messenger Muhammad (saw) to implement everything that Allah (swt) revealed to him, to rule and judge by it, and to not rule by anything other than it in any affair from among the affairs of life.

Allah (swt) said:

إِنَّا أَنْزَلْنَا إِلَيْكَ الْكِتَابَ بِالْحَقِّ لِتَحْكُمَ بَيْنَ النَّاسِ بِمَا أَرَاكَ اللَّهُ

Verily we have revealed the book to you in truth so that you judge between the people by what Allah has shown you (An-Nisaa 5).

Just as He Ta’Aalaa forbade him from following the desires of the people which means ruling by other than what Allah (swt) has revealed and He warned him that people will try to seduce and tempt him away from some of what Allah had revealed to him from the truth.

Allah (swt) says:

وَأَنْزَلْنَا إِلَيْكَ الْكِتَابَ بِالْحَقِّ مُصَدِّقًا لِمَا بَيْنَ يَدَيْهِ مِنَ الْكِتَابِ وَمُهَيْمِنًا عَلَيْهِ فَاحْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ عَمَّا جَاءَكَ مِنَ الْحَقِّ

And we have sent down to You (O Muhammad) the Book (this Qur'ân) in truth, confirming the Scripture that came before it and Mohayminan (trustworthy In highness and a witness) over it (old Scriptures) . So judge between them by what Allah has revealed and do not follow their desires away from the Truth that has come to you (Al-Maa’idah 48).

And He (swt) said:

وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ وَاحْذَرْهُمْ أَنْ يَفْتِنُوكَ عَنْ بَعْضِ مَا أَنْزَلَ اللَّهُ إِلَيْكَ

And judge between them by that which Allah has revealed and do not follow their desires and beware that they seduce you from some of what Allah has revealed to you (Al-Maa’idah 49).

The address (khitaab) to the Messenger (saw) is also an address to his Ummah so just as the ruling by what Allah (swt) has revealed is Waajib (obligatory) upon the Messenger (saw) it is also obligatory for all of the Muslims. Allah (swt) has commanded the Muslims to rule by what Allah (swt) has revealed explicitly in the Qur'aan with Qat'iy Thuboot (decisive/definite transmission) and Qat'iy Dalaalah (decisive/definite import and meaning) and it made the one who does not rule by what Allah has revealed a Kaafir, Zhaalim and Faasiq.

Allah (swt) said:

وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ

And whosoever does not rule by what Allah has revealed then they are the Kaafiroon (disbelievers) (Al-Maa'idah 44).

وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمُ الظَّالِمُونَ

And whosoever does not rule by what Allah has revealed then they are the Zhaalimoon (transgressors/oppressors) (Al-Maa'idah 45).

وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْفَاسِقُونَ

And whosoever does not rule by what Allah has revealed then they are the Faasiqoon (rebelliously disobedient) (Al-Maa'idah 47).

It also made Imaan tied to the ruling by what Allah (swt) has revealed:

فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ

Then no by your Lord, they will not believe until they go to you in judgement in that which they dispute about amongst themselves (An-Nisaa 65).

And it made obligatory upon the Muslims to submit absolutely and completely to the Hukm (rule) of Allah and His Messenger (saw) and for there to be no resistance within themselves in respect to the ruling of Islaam and its Hukm:

ثُمَّ لَا يَجِدُوا فِي أَنْفُسِهِمْ حَرَجًا مِمَّا قَضَيْتَ وَيُسَلِّمُوا تَسْلِيمًا

Then do not find within themselves any resistance to what you have judged and submit with the fullest submission (An-Nisaa 65).

Allah (swt) also commanded the believers to refer back to the judgment of Allah Ta'Aalaa and the Messenger (saw) if they differ and dispute with their rulers:

فَإِنْ تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّهِ وَالرَّسُولِ إِنْ كُنْتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الْآَخِرِ

Then if you have disputed in any matter then return it (refer it) to Allah and the Messenger if you believe in Allah and the Last Day (An-Nisaa 59).

It therefore made the referring to the Hukm of Allah and the Messenger a sign of having Imaan in Allah Ta'Aalaa and the Day of Judgment.

Due to what has been mentioned above the Fuqahaa of the Muslims and their Mujtahideen classified Daar ul-Islaam as the Daar (land) in which the Ahkaam (rulings) of Islaam are implemented and its Amaan (security) is secured by the Muslims. Therefore if the application of the Ahkaam of Islaam ceased and the Ahkaam of Kufr began to be implemented, the land would change to Daar ul-Kufr, and even if all of its population were Muslims.

The Messenger of Allah (saw) implemented Islaam completely in all areas and aspects of life according to what Allah (swt) revealed it to him just as the Khulafaa' Ar-Raashidoon applied Islaam in a complete manner after him. The application of Islaam then continued under the Khulafaa' throughout all of the Islamic eras despite the occurrence of misapplication on some occasions and specifically in areas related to the rulers themselves and the finances. In spite of this misapplication nothing was in the place of ruling other than Islaam and no other system other than it was implemented until the final era of decline in the latter days of the 'Uthmaani State. This was after the State had become weak and other the malicious missionary campaign conducted by the disbelieving western states. These began to work to create doubt in the Ahkaam of Islaam, its systems and its suitability and viability to solve the realities of life. They began to call to their civilisation, thoughts and systems which affected some of the Muslims and particular after the occurrence of the European revival and after the destruction of the Khilafah State which enabled these Western Kaafir States to eliminate the application of Islaam. It also enabled them implement their Systems and Ahkaam (rulings) in place of the Islaam and its Systems. This gave them the opportunity to focus their disbelieving thoughts and culture amongst the Muslims in order to completely distance them from the thoughts of Islaam, its culture, Systems and Ahkaam. This was also in order to prevent the return of Islaam to life, to the position of ruling and from the return of the Khilafah. This is in addition to keeping them in the position of dominance over the lands of the Muslims so that they could steal its treasures and natural resources and so that these lands become consumer markets for their products, a strategic hub and a first line of defence for their lands and States.

And when the Muslims discovered the falseness of the western disbelieving civilisation, when its corruption became manifest, its flaws became evident, its rotten odours spread, the true bloodsucking and ugly nature of America and the disbelieving western states which loot peoples of their wealth was revealed in addition to their spite and treacherous hostility towards Islaam and the Muslims, and when they saw the truth of what happened to the Muslims and their lands in terms of calamities, afflictions and the destruction that afflicted them, the establishment of Israel as a sword drawn over their heads and a dagger in their heart. After all of that the Muslims examined themselves and began to be convinced that there is no escape for them from what they suffer except by returning to Allah, through the return of His Rule in the reality of life, the implementation of Islaam in an absolutely complete manner in all areas of life, the return of the Khilafah to existence, and to get rid of all of the thoughts of Kufr, its systems and agents including the rulers and those who have placed themselves as deputies to the disbelievers to fight against the political Aqeedah of Islaam, its return to life's reality, to the rule, the return of the Khilafah and the return of the Hukm of Allah upon the earth. Those who showed no leniency or complacence in their war as they killed, imprisoned, tortured and prevented people from obtaining work and from travel, to the point where it appeared that the rulers of Jordan, Syria, Iraq and Egypt amongst other Arab Islamic lands had no concern other than fighting against the carriers of the Islamic Da'wah, those who carried Islaam upon a political basis, and fighting against the return of Islaam to life and the return of the Khilafah.

This is because these rulers do not fear anything in respect to their rule and positions other than the return of the Islaamic rule upon the earth. The return of the Islamic rule has become the concept and hope of the Muslims with the exception a group from amongst those who have become content with the western disbelieving culture who have been raised with it and thrived upon its thoughts and concepts, making themselves protectors of it after having adopted the western viewpoint established upon the separation of the Deen from life and the Deen from the State. This has made benefit the measure and the motivation for their viewpoint whilst this is contrary to Islaam and its viewpoint. This is because Islaam is not separate from the life; it has come to solve all of life's problems and has made the State a part of it because it is the method that it has made and obliged to implement its systems and Ahkaam. And it is because the viewpoint of Islaam and its criterion by which realities, events, systems and Ahkaam are measured is the Halaal and the Haraam, and this represents the incentive and motivation.

Indeed Allah has reproached those who wish to seek judgement to the Ahkaam of Kufr and Taghoot and not to Islaam.

Allah (swt) said:

أَلَمْ تَرَ إِلَى الَّذِينَ يَزْعُمُونَ أَنَّهُمْ آَمَنُوا بِمَا أُنْزِلَ إِلَيْكَ وَمَا أُنْزِلَ مِنْ قَبْلِكَ يُرِيدُونَ أَنْ يَتَحَاكَمُوا إِلَى الطَّاغُوتِ وَقَدْ أُمِرُوا أَنْ يَكْفُرُوا بِهِ وَيُرِيدُ الشَّيْطَانُ أَنْ يُضِلَّهُمْ ضَلَالًا بَعِيدًا

Have you seen those who claim that they believe in that which was revealed to you and what was revealed before you. They want to go to judgement to the Taghoot whilst they have been commanded to disbelieve in it. And Shaytaan wants to mislead them far astray (An-Nisaa' 59).

Indeed the return of Islaam to the reality of life and to the ruling will not occur by placing an article in the constitution stating that the official Deen of the state is Islaam or by including an article stating that Islaam is the source of the constitution and the laws. This is because this represents an inclusion based on appearance whilst it holds no real value and the rulers only resort to this in hypocrisy in an attempt to deceive and manipulate the Muslim masses. So despite this they remain upon the same standing forms of ruling systems and upon the same divisions, systems and laws that are applied in the lands without any change despite being in complete contradiction to Islaam and its rulings.

The return of Islaam to the reality of life and ruling will not occur unless the Islamic Aqeedah is made the basis of the constitution and all of its laws and all current forms of ruling are abolished and the system of the Khilafah and Imaamah returns, as it is the only shape and form of ruling in Islaam. All standing constitutions and laws must be abolished and replaced by a constitution and laws that are built upon the Islamic Aqeedah and taken from the Book of Allah, the Sunnah of His Messenger and what these two sources guide to in terms of Qiyaas and Ijmaa'. Without this happening, Islaam and its rulings would not have returned to the reality of life.

O Muslims:

Verily Allah has made it obligatory upon you to rule by Islaam in every affair from the affairs of your lives and he has made it obligatory upon you to abide by the Islamic viewpoint and to regard all realities, incidents, events, systems and thoughts upon this viewpoint which is the Halaal and the Haraam. It must be used as the criterion and measure so whatever is Halaal they view it as Halaal and act by it and whatever has been made Haraam, they view as Haraam and abstain from it. The criterion of the Halaal and the Haraam obliges you to work for the return of the Khilafah and the return of the rule of Allah upon the earth. So remove the sin from yourselves and don't be dissuaded by the rulers and their oppression and don’t let anything come between you and the work to return to Islaam whether this is represented in your wealth, sons, wives, tribe, trade or enjoyment. This is because all of these things are temporary and will not last and there is no excuse within them with Allah to refrain and stand back from being involved in the work. So respond to the command of Allah and attain the true success:

قُلْ إِنْ كَانَ آَبَاؤُكُمْ وَأَبْنَاؤُكُمْ وَإِخْوَانُكُمْ وَأَزْوَاجُكُمْ وَعَشِيرَتُكُمْ وَأَمْوَالٌ اقْتَرَفْتُمُوهَا وَتِجَارَةٌ تَخْشَوْنَ كَسَادَهَا وَمَسَاكِنُ تَرْضَوْنَهَا أَحَبَّ إِلَيْكُمْ مِنَ اللَّهِ وَرَسُولِهِ وَجِهَادٍ فِي سَبِيلِهِ فَتَرَبَّصُوا حَتَّى يَأْتِيَ اللَّهُ بِأَمْرِهِ وَاللَّهُ لَا يَهْدِي الْقَوْمَ الْفَاسِقِينَ

Say: If your fathers, your sons, your brothers, your wives, your relatives, wealth which you have obtained, commerce wherein you fear decline, and dwellings with which you are pleased are more beloved to you than Allah and His Messenger and Jihad [i.e. striving] in His cause, then wait until Allah executes His command. And Allah does not guide the Faasiqeen (defiantly disobedient people) (At-Taubah 24).

Q&A: Age of separating children in the beds?

Question: Please explain the hukm regarding separation of children in their beds. At what age is separation an obligation upon the parents? Also can a parent sleep in the same bed as their child?
